Welcome to Emberly. These Terms of Service (“Terms”) govern your access to and use of our website, products, and services. By visiting our site or making a purchase, you agree to be bound by these Terms.

1. General Conditions

  • This website is operated by Emberly Bakery, Edmonton, Alberta, Canada.
  • By using our Services, you represent that you are at least 18 years of age, or you have permission from a parent or legal guardian.
  • We reserve the right to refuse service to anyone, for any reason, at any time.
  • You agree not to use our products for any illegal or unauthorized purpose.

2. Products

  • All items sold by Emberly are freshly baked, high-protein, no-sugar desserts.
  • Because our products are handmade and perishable, slight variations in appearance, size, or flavor may occur.
  • Ingredients and allergen information are listed on product descriptions and/or packaging. It is the customer’s responsibility to review all allergen information before purchase or consumption. Emberly is not responsible for allergic reactions.

3. Orders & Payments

  • All orders must be paid in full at the time of purchase.
  • We accept payment methods offered at checkout (Shopify Payments, PayPal, credit/debit cards).
  • Prices are subject to change without notice.
  • Promotions, discounts, and free shipping offers may be time-limited and cannot be applied retroactively.

4. Shipping & Delivery

  • Orders are processed within 1–2 business days, unless same-day delivery is selected (available in Edmonton only, subject to product availability and driver capacity).
  • Same-day delivery (early-hours orders): orders placed before 10:00 AM MST may be delivered between 12:00 PM and 11:00 PM MST.
  • Delivery times outside Edmonton: 2–7 business days within Canada, depending on carrier.
  • We are not responsible for delivery delays caused by carriers, weather, or incorrect address information provided by the customer.
  • It is the customer’s responsibility to provide a correct, complete shipping address. Orders returned due to incorrect addresses are not eligible for refund; reshipment may be offered at the customer’s expense.

5. Returns, Refunds & Cancellations

  • Due to the perishable nature of our products, all sales are final.
  • We do not accept returns or exchanges for baked goods once they have left our bakery.
  • If your order arrives damaged, incorrect, or missing items, you must notify us within 24 hours of delivery with photos and order details at support@emberlybakery.com.
  • Approved claims may result in a replacement order or a digital gift card (store credit) in line with our Return & Refund Policy.
  • Orders may be canceled within 1 hour of purchase. After that, production begins and cancellations are not possible.

6. Freshness & Storage

  • Our products are baked fresh with no preservatives.
  • Customers are responsible for proper storage as indicated on product packaging. Emberly is not liable for spoilage due to improper handling or storage after delivery.

7. Accuracy of Information

  • We strive to provide accurate product descriptions, nutritional information, and images. However, we do not guarantee that all details are error-free.
  • Nutritional values are estimates and may vary slightly depending on portion sizes and ingredients.

8. Intellectual Property

  • All content on this website, including logos, text, images, graphics, and product designs, are the property of Emberly and may not be reproduced without permission.

9. Limitation of Liability

  • To the fullest extent permitted by law, Emberly shall not be liable for:
    • Allergic reactions due to consumption of our products.
    • Losses caused by shipping delays, incorrect addresses, or customer negligence.
    • Any indirect, incidental, or consequential damages.
  • Our total liability shall not exceed the purchase price of the product in question.

10. Governing Law

  • These Terms are governed by and construed in accordance with the laws of Alberta, Canada.
  • Any disputes shall be resolved exclusively in the courts of Alberta.

11. Changes to Terms

  • Emberly reserves the right to update or replace these Terms at any time.
  • The latest version will always be posted on this page, with the updated date shown above.
  • Continued use of our Services constitutes acceptance of the updated Terms.
